		Terms of Service By using BestDogSearch.com, or having your kennel listed there in CREATES AN AGREEMENT BETWEEN YOU THE CUSTOMER AND BestDogSearch.com THAT YOU ARE AGREEING TO THE TERMS OF THIS AGREEMENT AND ALL TERMS AND CONDITIONS INCORPORATED BY REFERENCE IN THIS AGREEMENT, INCLUDING BestDogSearch.com's USAGE POLICY. YOUR USE OF THE SERVICES CONSTITUTES ACCEPTANCE OF THIS AGREEMENT. Under this Agreement, Customer shall comply with BestDogSearch.com's then current Acceptable Use Policy ("AUP"), as amended, modified or updated from time to time by BestDogSearch.com, which currently can be viewed under the Terms of Service (TOS) section of this web site, and which is incorporated in this Agreement by reference. Customer hereby acknowledges that it has reviewed the AUP and that the terms of the AUP are incorporated herein by reference. In the event of any inconsistencies between this Agreement and the AUP, the terms of the AUP shall govern. BestDogSearch.com does not intend to systematically monitor the content that is submitted to, stored on or distributed or disseminated by Customer via the Service (the "Customer Content"). Customer Content includes content of Customer's customers and/or users of Customer's website. Accordingly, under this Agreement, you will be responsible for your customers content and activities on your website. Notwithstanding anything to the contrary contained in this Agreement, BestDogSearch.com may immediately take corrective action, including removal of all or a portion of the Customer Content, disconnection or discontinuance of any and all Services, or termination of this Agreement in the event of notice of possible violation by Customer of the AUP. In the event BestDogSearch.com takes corrective action due to a violation of the AUP, BestDogSearch.com shall not refund to Customer any fees paid in advance of such corrective action. Customer hereby agrees that BestDogSearch.com shall have no liability to Customer or any of Customer's customers due to any corrective action that BestDogSearch.com may take (including, without limitation, disconnection of Services). We at BestDogSearch.com reserve the right to cancel or suspend your account or any other service provided by us if we believe the account is being used inappropriately. Failure to comply with this policy will result in termination of your BestDogSearch.com contract. It is at the decision of BestDogSearch.com what is acceptable content and what is not. Any service provided by BestDogSearch.com may only be used to lawful purposes. Storage, transmission or presentation of any data or information that violates any law is prohibited. Copyright material and material that is obscene or protected by trade secret or invasion of privacy is also prohibited. The subscriber agrees to indemnify and hold harmless BestDogSearch.com from any claims resulting from the use of the service which damages the subscriber or any other party. Sites with sex related data or pornographic content of any a kind is prohibited. This includes links to content of this kind elsewhere. It is at the decision of BestDogSearch.com what acceptable content is. Sites that promote illegal activity or sites that contain content that may be damaging to BestDogSearch.com servers or any other server on the internet is prohibited, this also includes links. Unacceptable content includes pirated software, hacker programs and warez sites. PLEASE NOTE: Only websites or URLs with content specific to and relevant to the ethical breeding of dogs will be accepted for submission to the searchable database and resources available at http://www.BestDogSearch.com. We reserve the right to remove submissions that do not meet this condition. PRIVACY BestDogSearch.com takes your privacy very seriously. We DO NOT and WILL NOT sell any information obtained on this site from breeders to any 3rd party. 1. BestDogSearch.com provides users with access to a variety of community business resources. You also understand and agree that the Service may include advertisements and that these advertisements are necessary for BestDogSearch.com to provide the service. You also understand and agree that the service may include certain communications from BestDogSearch.com, such as service announcements, administrative messages and that these communications are considered part of BestDogSearch.com. 2. You understand and agree that the Service is provided "AS-IS" and that BestDogSearch.com assumes no responsibility for the timeliness, deletion, mis-delivery or failure to store any user communications or personalization settings. You are responsible for obtaining access to the Service and that access may involve third party fees (such as Internet service provider or airtime charges). BestDogSearch.com MAKES NO WARRANTY THAT (i) THE SERVICE WILL MEET YOUR REQUIREMENTS, (ii) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (iii) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE, (iv) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SERVICE WILL MEET YOUR EXPECTATIONS, AND (V) ANY ERRORS IN THE SOFTWARE WILL BE CORRECTED. LIMITATION OF LIABILITY YOU EXPRESSLY UNDERSTAND AND AGREE THAT BestDogSearch.com SHALL NOT BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF BestDogSearch.com HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: (i) THE USE OR THE INABILITY TO USE THE SERVICE; (ii) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM THE SERVICE; (iii) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (iv) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICE; OR (v) ANY OTHER MATTER RELATING TO THE SERVICE. 11. BestDogSearch.com may provide you with notices, including those regarding changes to the TOS, by either email, regular mail, or postings on the Service. 12. You agree to indemnify and hold BestDogSearch.com, and its subsidiaries, affiliates, officers, agents, co-branders or other partners, and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of Content you submit, post, transmit or make available through the Service, your use of the Service, your connection to the Service, your violation of the TOS, or your violation of any rights of another. BREEDER CODE OF ETHICS All breeders listed in the BestDogSearch.com directory and who offer puppies for sale or adult dogs for sale to the public, are currently being asked to agree to the following Code of Ethics and to be bound by its standard of behavor. Documented proof of failure to comply will result in removal from the BestDogSearch.com directory. I will provide information on the characteristics and properties of the breed to the interested individuals. I will maintain a safe, clean and sanitary facility for all stud dogs, bitches, adult dogs for sale and puppies for sale. I will be knowledgeable about inherited health problems in my breed and will do appropriate health clearances on all breeding animals. Copies of these health clearances will be available to buyers of adult dogs for sale and puppies for sale. I will not knowling misrepresent the characteristics of the breed, nor falsely advertise, or mislead any person regarding the performance of any dogs for sale or puppies for sale. I will not breed any male or female until they are both physically and mentally mature, and I will not continue to breed any male or female beyond an appropriate age for the breed. I will comply with all federal, state or provincial and local government laws and regulations concerning the keeping of dogs. If puppies offered for sale to persons inquiring through BestDogSearch.com directory are to be registered, they will be registered only with the American Kennel Club, United Kennel Club, Canadian Kennel Club or other registry with equivalent standards and requirements. If such puppies are not to be registered, I will inform the buyer of that fact in writing. I will refrain from relasing any puppy until it is at least seven (7) weeks old, or eight (8) weeks old if the puppy is to be shipped. I will show discrimination in the sale of my puppies and be concerned with the types of homes in which they are placed. I will make buyers aware of their responsibilites as a dog owner. I will not deliberately degrade any fancier, their dogs, or their kennel. I agree to be a resource for buyers of puppies or older dogs that I have sold for the life of the dog. All breeders in the BestDogSearch.com directory are being asked to agree to the above Code of Ethics and to be bound by it's standard of behavoir.
